Terms & Conditions
These Terms govern your use of the Flee Aviation website and trip-inquiry services. They do not constitute a contract for air transportation.
1. Acceptance and eligibility
By accessing this website or submitting a trip request, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the website or submit a request. You must be at least 18 years old. If you act for a company or another person, you represent that you have authority to do so and to provide the information submitted.
2. Flee's current role
Flee provides preliminary trip-coordination and inquiry communication. We may help clarify a requested route, timing, airport options, and ground arrangements and may communicate relevant details to appropriately authorized operators or other providers.
Submitting a request does not create an agency, brokerage, fiduciary, partnership, joint-venture, carriage, or booking relationship. Flee does not accept payment for air transportation through this website. If Flee later agrees in writing to provide a regulated brokerage or other service, the specific written disclosures and terms for that service will control.
3. Air transportation is separate
Flee does not own, operate, maintain, schedule, dispatch, or crew aircraft; sell passenger seats; select or assign pilots; exercise operational control; or make safety and go/no-go decisions. A Commercial Pilot Certificate alone does not authorize a pilot to offer passenger air transportation to the public. Flee will not combine a separately sourced aircraft and pilot to avoid applicable FAA or Department of Transportation requirements.
Any passenger flight must be performed by an air carrier or operator holding the authority required for that operation, including applicable Part 119 certification and Part 135 operating authority. The operator controls the aircraft, crew, flight planning, passenger and baggage requirements, safety decisions, schedule, route, substitutions, delays, and cancellation decisions.
4. Requests, estimates, and operator contracts
A trip request is only an inquiry. Website examples, estimated drive or flight times, possible airports, aircraft references, availability statements, and preliminary communications are illustrative and may be incomplete or change. They are not offers, reservations, guarantees, safety determinations, or binding quotes.
No flight is confirmed until an authorized operator accepts the mission and provides written confirmation under its own contract and conditions of carriage. You are responsible for reviewing the operator's identity, authority, aircraft, insurance information, total price, cancellation terms, baggage rules, and other disclosures before agreeing or paying. An operator's contract governs the air transportation.
5. Ground arrangements and other third parties
Rental cars, drivers, meeting rooms, restaurants, lodging, event access, and other ground services are provided by independent third parties under their own terms, privacy policies, availability, fees, and cancellation rules. Flee does not control and is not responsible for their acts, omissions, condition, safety, quality, or performance. Unless expressly confirmed in writing, a coordination request is not a reservation.
6. Trip timing and inherent risks
Aviation and travel involve risks outside Flee's control. Weather, maintenance, airport conditions, air traffic control, aircraft performance, crew duty limits, government action, security requirements, wildfire or smoke, mountain conditions, road conditions, and safety concerns can delay, reroute, substitute, interrupt, or cancel a trip.
Do not make nonrefundable or time-critical commitments in reliance on a request, estimate, or proposed itinerary. Build reasonable flexibility into meetings, events, onward travel, and ground arrangements. The operator alone decides whether and how a flight may safely and legally operate.
7. Your responsibilities
You agree to provide complete and accurate contact, traveler, timing, baggage, accessibility, and itinerary information; promptly update material changes; comply with operator and provider instructions; and ensure that every traveler receives applicable terms and notices.
Disclose hazardous materials, unusual baggage, animals, mobility needs, and information affecting safe carriage directly to the operator. Do not submit payment-card numbers, passports, government identifiers, medical records, or other sensitive information through the general trip-request form.
8. No emergency, medical, or professional service
The website is not an emergency dispatch, air-ambulance, medical, legal, insurance, security, or safety-advisory service. Do not use it for urgent or emergency assistance. Call 911 or the appropriate emergency service when immediate help is required. Flee does not provide or sell travel, medical, cancellation, or aviation insurance.
9. Acceptable use and submitted content
You may not misuse the website; interfere with its operation or security; submit false, fraudulent, unlawful, threatening, infringing, or malicious content; impersonate another person; scrape or reverse engineer the service; introduce malware; or use the website to arrange unlawful transportation.
You retain ownership of information you submit. You grant Flee a limited, nonexclusive right to use, reproduce, and share it only as reasonably necessary to respond to the request, evaluate options, coordinate requested services, prevent misuse, maintain records, and comply with law, as described in the Privacy Policy.
10. Intellectual property and feedback
The Flee name, branding, website design, text, graphics, and other site content are owned by Flee or its licensors and are protected by applicable law. You may use the website for personal or internal business inquiry purposes but may not copy, republish, sell, or exploit its content without written permission. If you voluntarily provide feedback, Flee may use it without restriction or compensation, provided we do not publicly identify you without permission.
11. Third-party links and communications
Links to FAA resources, operators, providers, or other websites are provided for convenience and do not constitute endorsement or a warranty. Third-party sites and communications are governed by their own terms and privacy practices. You access and use them at your own risk.
12. Disclaimer of warranties
To the fullest extent permitted by law, the website and preliminary coordination services are provided “as is” and “as available.” Flee disclaims express and implied warranties, including merchantability, fitness for a particular purpose, title, noninfringement, uninterrupted availability, accuracy, completeness, security, and that any requested trip or arrangement will be available, suitable, lawful, safe, or completed.
Nothing in these Terms limits any warranty or right that cannot lawfully be excluded.
13. Limitation of liability
To the fullest extent permitted by law, Flee and its owners, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; lost profits, revenue, business, opportunity, data, or goodwill; or costs of substitute travel, arising from the website, a trip inquiry, an operator or provider, a delay or cancellation, or your reliance on preliminary information.
To the fullest extent permitted by law, Flee's total aggregate liability for claims arising from the website or Flee's preliminary coordination services will not exceed the greater of US $100 or the amount you paid directly to Flee for those services during the 12 months before the event giving rise to the claim. This limitation does not apply to liability that cannot lawfully be limited or excluded.
14. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Flee and its owners, officers, employees, contractors, and affiliates from third-party claims, losses, liabilities, damages, judgments, and reasonable costs, including attorneys' fees, arising from your breach of these Terms, unlawful or fraudulent use of the website, inaccurate or unauthorized submissions, violation of another person's rights, or information you provide about other travelers without authority. This obligation applies only to the extent the claim results from your acts or omissions.
15. Events beyond reasonable control
Flee is not responsible for delay or failure caused by events beyond its reasonable control, including severe weather, natural disaster, wildfire, epidemic, war, terrorism, civil unrest, government action, labor disruption, utility or telecommunications failure, cyberattack, provider outage, airport closure, air traffic restriction, or failure of an operator or other third party.
16. Suspension and termination
Flee may decline a request or suspend access when reasonably necessary to address suspected fraud, unlawful activity, safety concerns, abuse, sanctions or legal restrictions, inaccurate information, or violation of these Terms. Provisions that by their nature should survive termination, including intellectual-property, disclaimer, liability, indemnity, dispute, and general provisions, will survive.
17. Governing law and disputes
These Terms are governed by Colorado law, without regard to conflict-of-law rules. Before filing a claim, you agree to send a written description to contact@fleeaviation.com and allow 30 days for a good-faith effort to resolve it. Subject to applicable law, any unresolved dispute relating to these Terms or the website must be brought in the state or federal courts located in Denver, Colorado, and each party consents to their jurisdiction and venue.
18. Changes to these Terms
We may update these Terms as the website or services change. The effective date identifies the current version. Material changes will apply prospectively after posting or other reasonable notice. A separately confirmed operator or provider contract remains governed by the version and terms applicable to that contract.
19. General provisions
These Terms are the entire agreement concerning use of this website and preliminary trip-inquiry services, except for any separate written agreement. The Privacy Policy and Cookie Policy describe our data and technology practices. If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest will remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without Flee's written consent; Flee may assign them in connection with a reorganization, financing, merger, sale, or transfer of the business.
